SELANGOR Dredging Bhd (SDB) has disclosed that its wholly owned subsidiary, SDB Properties Sdn Bhd (SDBP), has been served with a writ of summons from Condolink Sdn Bhd over alleged trespass relating to a property development in Shah Alam.
The writ, filed in the Shah Alam High Court on July 28, names both SDBP and its main contractor, Inta Bina Sdn Bhd (IBSB), as defendants.
The dispute involves SDBP’s development project comprising superlink homes and condominium villas near Lot 1195, which is owned by Condolink.
Condolink claims that SDBP and IBSB, through their agents or employees, unlawfully entered its land by clearing trees, constructing worker quarters, and creating road access, which allegedly caused losses to the company.
The plaintiff contends that SDBP and its contractor owed a non-delegable duty of care not to encroach upon its land.
In response, Condolink is seeking a court injunction to stop further entry, an order compelling the restoration of the affected land, and compensation including RM1.07 million in special damages.
The company is also pursuing general, aggravated and exemplary damages, along with interest and legal costs.
SDB has denied all allegations, including the claim of trespass, stating that the suit is without merit and based on a misinterpretation of the facts and circumstances.
It maintains that there is no basis for the claims and that SDBP will mount a strong defence.
Legal counsel has been appointed to represent SDBP, and the company expressed confidence in its legal position. — TMR
