INFOMINA Bhd’s 99.95%-owned subsidiary, Infomina Philippines Inc, has initiated a civil lawsuit against the Bank of the Philippine Islands (BPI), seeking PHP1.65 billion (approximately RM133 million) in damages arising from a dispute over a software purchase and maintenance agreement.
According to the company’s filing with Bursa Malaysia, the lawsuit was filed on Aug 5, 2025, at the Regional Trial Court of Makati.
The legal action follows BPI’s alleged invalid termination of a contract signed on Oct 29, 2021, and its failure to report the usage of resold software in accordance with the agreed terms.
Infomina claims that BPI terminated the agreement unilaterally on Sept 22, 2022.
Furthermore, the bank allegedly failed to provide usage reports, which triggered overage fees under the contract terms.
The claims filed include unpaid subscription fees, overage charges, interest, legal fees, and other costs.
The group noted that it has already made a provision for doubtful debts amounting to approximately RM10 million related to this case, which has been reflected in its unaudited financial results for the year ended May 31, 2025.
Infomina said the civil case is not expected to have any immediate material financial or operational impact on the group for the financial year ending May 31, 2026.
The company has appointed Ocampo & Suralvo Law Offices to represent it in the proceedings and remains optimistic about the merits of its claim.
BPI will have 30 days from the date it receives the official summons, extendable by another 30 days, to file its defence. — TMR
