KERJAYA Prospek Group Bhd has secured a RM75.46 million adjudication award against Yong Tai Bhd’s unit, Apple 99 Development Sdn Bhd, over unpaid construction work for a mixed development project in Melaka, known as “The Apple.”
The adjudicator ordered Apple 99 to pay the amount — 71.8% of the RM105.14 million outstanding sum claimed — along with interest to Kerjaya Prospek’s wholly owned subsidiary, Kerjaya Prospek (M) Sdn Bhd (KPM).
The dispute stems from a RM213.75 million contract awarded in 2016 for the construction of a hotel, serviced suites, and a parking podium.
KPM had earlier filed a lawsuit against Apple 99, alleging breach of a 2020 settlement agreement and seeking to enforce both the settlement and a hotel sale agreement.
Apple 99 counterclaimed, citing a 2023 supplementary agreement and sought RM76.62 million for alleged losses due to project delays and defects.
The legal battle is ongoing, with trial dates set for October.
Separately, KPM has also filed a suit against Yong Tai and its CEO Datuk Boo Kuang Loon to recover the RM105.14 million based on corporate and personal guarantees. — TMR
