MOH to explain legal basis for private sector medicine pricing

THE Health Ministry (MOH) has been directed to investigate concerns raised by doctors and private healthcare providers over medication pricing and the enforcement of related regulations.

Communications Minister Datuk Fahmi Fadzil said the matter surfaced following reports that general practitioners (GPs), private clinics and pharmacies had submitted memorandums to the MOH.

“These memorandums relate to concerns about the pricing of medicines in private clinics, hospitals and pharmacies,” he said at a press conference today.

Among the issues raised was the reported use of Article 7.23 under the Anti-unification Act, which falls under the National Drug Policy (NDP), in addressing these pricing concerns.

“There are doctors and private clinics asking why Article 7.23 is being used instead of Article 586,” Fahmi said, referring to a separate provision commonly used to regulate pricing and service standards in the private healthcare sector.

He added that the MOH has been asked to clarify the rationale for invoking Article 7.23 and to provide an immediate explanation.

Fahmi also noted that the government would review Article 586, which governs consultation fees at private clinics, to assess whether it is being applied fairly and consistently.
